Consignment Agreement
The following is the actual agreement terms used between Street Sports and any person who would like to have our shop sell their items. This is a service that we provide to our customers who are trying to upgrade or simply have an item they can no longer utilize. All items for consignment must be available for sale on our premises so that items may be taken upon purchase. We plan to have every consignment item available for viewing on our website. Agreement made by and between Consignor and Street Sports (Consignee)
Street Sports acknowledges receipt of goods as described on annexed schedule. Said goods shall remain property of Consignor until sold. Consignor may from time to time add additional consigned goods as desired.
Street Sports, at it's own cost and expense, agrees to keep and display the goods only in it's place of business, and agrees, on demand made before any sale, to return the same in good order and condition. Street Sports may at it's own election return goods to Consignor.
Street Sports agrees to use it's best efforts to sell the goods for the Consignor's account on cash terms, and at such prices as shall from time to time be set by Consignor, and at no lesser price.
Street Sports agrees, upon sale, to maintain proceeds due Consignor in trust, and separate and apart from it's own funds and deliver such proceeds, less commission, to Consignor together with an accounting within 5 (five) days of said sale.
Street Sports agrees to accept as full payment a commission equal to 25% (twenty five percent) of the gross sales price (exclusive of any sales tax or shipping charges, which Street Sports shall collect and remit).
Street Sports agrees to permit the Consignor to enter the premises at reasonable times to examine and inspect the goods, and reconcile an accounting of sums due.
Street Sports acknowledges that title to the goods shall remain with the Consignor until goods are sold in the ordinary course of business.
Risk of loss of the goods shall be the responsibility of the Consignor while said goods are within Street Sports' possession.
This agreement may be terminated by either party at will. Upon termination all unsold goods shall be returned minus 10% (ten percent) commission.
This agreement is not assignable and shall not be modified except by written modification.
This agreement shall be binding upon and inure to the benefit of the parties, their successors, assigns and personal representatives.
